Livingston County Sheriff 02/10/2023 – Incident Reports, MOST Wanted, Arrests and MORE Public Information
Incident Reports:
January 21 LCSO received information about suspicious people in a vehicle in the 11000 block of LIV 233. Both occupants did not have a valid driver’s license and were waiting on a 3rd person to arrive. Both people were given a ride to their residence.
January 21 a Dawn resident called to report his dog being attacked by a neighbor’s dog(s) on the neighbor’s property. Although there are no leash laws in Dawn or Livingston County but there are other state statutes involving animal trespassing and care. The best advice to everyone is make certain your pet remains on your property. Some may need a kennel, fencing, or other means to make this happen. Many would be surprised where their pets travel and what they do when not restricted to the animal owner’s property.
January 22 about 6:14 p.m. LCSO investigated a report of assault to a family member where an elderly female reported her grandson had physically assaulted her. Investigation shows the assault was an accident and no prosecution was requested. Other services are involved in assisting this family.
January 25 LCSO began a fraud investigation where an area resident allegedly used another person’s credit card to purchase item(s) locally. The suspect in this case is currently on probation for class C felony conviction of receiving stolen property.
January 27 LCSO assisted Children’s Division on a hotline call of possible child abuse. Investigation shows no evidence of any criminal violation after several interviews.
January 30 about 8:57 p.m. LCSO investigated report of domestic disturbance on U.S. 36 near Utica. All persons were interviewed, no physical marks or injuries, neither adult wanted to cooperate with prosecution and both agreed to separate for the night.
January 30 Deputy Sheriff/School Resource Officer Mike Lewis filed a report through this office about detaining a reported run-a-way juvenile. Information to parent(s) and juvenile office.
January 31 LCSO and CDES assisted a juvenile who was allegedly planning suicide. Information shared with family/guardian and juvenile office.
February 01 LCSO began an investigation of Burglary, Stealing, Tampering with Motor Vehicle-1st degree and Forgery in the 8000 block of LIV 511. Investigation has resulted in warrants being issued for 2 people at this time.
February 01 LCSO took a report from a senior citizen that his sleep medication had been lost or stolen.
February 04 at 3:41 p.m. LCSO took a report at HMC of a dog bite to a person. The victim was the dog owner and no additional issue pending.
February 07 LCSO began an investigation of burglary and stealing in the 15000 block of LIV 240. Victim reported the crime took place between early December and January 22, 2023. Evidence shows forced entry into the building and at minimum the following items were stolen: Lincoln Wire Feed 120V Welder, Auto darkening welding helmet, heavy duty welding helmet, chipping hammer, Transmission Jack, Porta Power 4-ton with case and kit, Stihl cut-off saw, Husqvarna 357 XP chain saw, forced air kerosene space heater and 8 gallons kerosene, Black and Decker battery charger, Ever Start super six battery charger and an Interstate deep cycle battery. Investigation continues.
February 08 LCSO took a report from a senior citizen they had sent $20,000 to scammers more than 1 year ago and have remained in contact with these people who are now wanting an additional $43,000 sent to them and in return has promised to send back over $400,000 to the victim. Additional assistance for victim has been contacted.
February 09, afternoon the LCSO began investigation of a new dog bite incident from a reported vicious animal in Dawn. The alleged owner has previously been contacted by the LCSO multiple times about concerns, care and requirements for the dog(s) due to their vicious nature and concerns on proper animal care. The LCSO has confirmed through the owners relative the dog(s) is being put down today by a vet in conjunction to health center requirements for safe testing. Report is being submitted to the prosecuting attorney for consideration of charge(s). Victim was not seriously injured.

Arrested January 24:
Bryan Michael Flemming, 37, Chillicothe, by Chillicothe PD on Livingston County arrest warrant for alleged Failure to Appear in Court on original 2 counts class A misdemeanor Non-Support. Bond set at $2,000 cash on case #22LV-CR00327. LCSO Jail Management records shows Mr. Flemming was arrested and incarcerated on this warrant October 05 through 07, 2022 and released on ROR bond.
Added January 25:
Update: Arrested January 25 by authorities in Caldwell County. Wesley D. Swyers, 43, Steelville, wanted on Livingston County arrest warrant for alleged Probation Violation on original class D felony DWI-Aggravated Offender. Bond denied on case #22LV-CR00465-01. LCSO Jail Management records show Mr. Swyers was initially arrested/incarcerated on this case September 01 until December 01, 2022 when he was released on ROR bond.
CANCEL. Arrested 1-25-23 by LCSO. Madeline Grace Ellis, 18, formerly of Dawn, wanted on Livingston County arrest warrant for alleged Failure to Obey a Judge’s Order on original class D felony Possession of Controlled Substance. Bond set at $10,000 on case #22LV-CR00672. LCSO Jail Management records show Ms. Ellis was initially arrested/incarcerated on this warrant December 30, 2022 and released on ROR bond January 04, 2023.

Heather L. Woods, 28, by Grundy County authorities on Livingston County arrest warrant for alleged Probation Violation on original charge class D felony Endangering the Welfare of a Child Creating Substantial Risk-1st degree-1st offense-No Sexual Contact. Bond set at $20,000 on case #21LV-CR00308-01.
Arrested February 04:
Julius Boyd, 43, by Kansas City Kansas Police on Livingston County arrest warrant for Alleged Violation of Bond Conditions on original class D felony Possession of a Controlled Substance. Bond set at $10,000 on case #18LV-CR00289-01 with warrant dated August 24, 2018. Updated August 27, 2018 to NO BOND allowed.
Added February 10:
Joshua J. Miley, 36, wanted on Livingston County arrest warrant for alleged class D felony Forgery, class D of felony of Burglary-2nd degree and class D felony of Tampering with Motor Vehicle-1st degree. Bond set at $15,000 cash on case #23LV-CR00056. Mr. Miley is reportedly on parole for Robbery-2nd degree and Burglary-2nd degree after being released from the Missouri Department of Corrections in December 2022 and we now have these charges for a recent incident. Mr. Miley is well aware of the warrant and allegedly hiding in Pettis County, MO.
Madeline Grace Ellis, 18, Braymer is wanted on Livingston County arrest warrant for alleged Failure to Obey Judge’s Order on original class D felony Possession of Controlled Substance. Bond denied by the court on case #22LV-CR00672. The warrant lists the alleged failure as absconding from furlough. LCSO Jail Management records shows LCSO originally arrested Ms. Ellis on December 30, 2022 on an investigation in Dawn and she was incarcerated on this case until January 04, 2023 and released on ROR bond. Ms. Ellis allegedly failed to obey a judge’s order and she was again arrested on January 25 and help until February 08, 2023 when she was again released from custody. We are again looking for Ms. Ellis.

January 25 about 11:30 p.m. LCSO made a traffic stop near Wheeling and that investigation resulted in the arrest of Antonio Elijah Spraggins, 29, Kansas City on warrants from Livingston County for alleged Failure to Appear in Court on Operate Vehicle without Driver’s License ($250.00) cash only bond and Resisting Arrest ($250.00) cash only bond. Blue Springs Municipal Warrants for alleged Failure to Appear in Court on original cases of Driving While Suspended ($2,000) cash only bond, Non Moving Traffic ($2,000) cash only, Protection Order ($500.00) cash only bond and Violation of Court Order ($500.00) cash only bond. Platte County arrest warrant for alleged Failure to Appear in Court on Moving Traffic Violation ($500.00) cash only bond. Kansas City Municipal arrest warrants for alleged Failure to Appear in Court on Traffic Offense ($150.00) cash only bond and Traffic Offense ($150.00) cash only bond. Raytown Municipal arrest warrants for alleged Failure to Appear in Court on Making False Report ($1,000) cash only bond and Assault Physical Contact ($1,000) cash only bond. Mr. Spraggins was transferred to the Caldwell County Detention Center in lieu of bond.
January 26 about 9:35 a.m. deputies arrested Nicholas David Wheeler, 32, Chillicothe on 2 Livingston County arrest warrants for alleged class D misdemeanor Failure to Appear in Court on original No Financial Responsibility and class B misdemeanor alleged Failure to Appear in Court on Failure to Register Motor Vehicle. Mr. Wheeler was processed at the Law Enforcement Center and released on cash bond with a new court date.
February 02 about 9:22 p.m. LCSO arrested Kenten Michael Williams, 53, in the 7000 block of LIV 251 on Livingston County arrest warrant for alleged Probation Violation on original class C felony Delivery of Controlled Substance-Methamphetamine. Warrant lists alleged probation violation as being DRUGS, for allegedly using methamphetamine. Mr. Williams was processed and transferred to the Caldwell County Detention Center in lieu of bond.
February 03 LCSO arrested Alyssa Nicole Ground, 26, North Kansas City, on Caldwell County arrest warrant for alleged Failure to Appear on Excessive Speeding. Ms. Ground posted the $300 bond and was processed and released from the LEC.
February 04 LCSO arrested Amanda Nicole Scheib, 29, Chillicothe on Livingston County arrest warrant for alleged class D felony Stealing-$750 or more with $5,000 bond and class D felony of Forgery with $7,500 bond. Ms. Scheib was processed at the LEC and transferred to the Harrison County Detention Center in lieu of bond.
February 09 LCSO arrested Leon Walter, 44, on Livingston County arrest warrant for alleged Unlawful Possession of a Firearm. Mr. Walter was transferred to the Caldwell County Detention Center in lieu of bond.

January 21 at 12:56 p.m. a Michigan driver was cited for 89 in a 65 on U.S. 36 near Wheeling.
January 22 at 2:23 p.m. a Chillicothe driver was cited for Failure to Register Motor Vehicle Annually by having June 2022 license plates.
January 25 at 5:05 p.m. a deputy stopped a vehicle matching call of a careless and imprudent driver near Calhoun and Dickinson Streets. The Dawn driver was cited for Failing to Register Motor Vehicle with DOR.
January 28 at 12:15 a.m. an Oklahoma driver was cited for 80 in a 65 on U.S. 36 at Wheeling Junction.
January 28 at 10:40 a.m. a Chillicothe driver was cited for Failure to Register Motor Vehicle on a stop on Washington and First Streets.
January 28 at 1:10 p.m. a Kirksville driver was cited for 85 in a 65 on U.S. 36 near Wheeling.
January 28 at 2:05 p.m. an Illinois driver was cited for 89 in a 65 on U.S. 36 and LIV 251.
January 28 at 2:40 p.m. a Lees Summit driver was cited for Failure to Register a Motor Vehicle on a stop on U.S. 65.
January 28 at 3:45 p.m. a Chillicothe driver was cited for Failure to Register Motor Vehicle (must appear) on a top at Washington and Waples. This was the second stop on the vehicle with the owner apparently refusing to register the motor vehicle.
January 29 at 8:40 p.m. a Chillicothe driver was cited for no auto insurance on a stop on Washington Street.
February 03 a Gallatin driver was cited for Failure to Register Motor Vehicle on a stop on Highway 190 near U.S. 65.
February 04 at 3:30 p.m. a Chillicothe driver was cited for no signal and no seat belt. The same vehicle had recently ran from and eluded a deputy recently.
February 04 at 6:10 p.m. a Liberty driver was cited for 80 in a 65 on U.S. 36.
February 04 at 7:48 p.m. a Chillicothe driver was cited for no auto insurance on a stop at Highway 190 and LIV 239.
February 04 at 10:00 p.m. a Chillicothe driver was cited for no auto insurance on a stop on 65 near Coach K road.
February 05 at 6:25 p.m. a Chillicothe driver was cited for Failure to Register Motor Vehicle on a stop at Washington and Polk Streets.
February 06 at 7:40 p.m. a Kearney driver was cited for excessive speed of 84 in a 65 on U.S. 36 at Mooresville.
Additional Information:
February 03 LCSO made a vehicle stop on a pickup that had no license or registration. LCSO has stopped this vehicle two times recently with citation(s)/warnings issued for the violations. This instance resulted with enforcement and the vehicle being towed from the scene due to being illegal to operate on the roadways.
February 03 LCSO transported Patrick Oyler to the Missouri Department of Corrections in St. Joseph on a parole violation warrant.
February 08 about 1:30 a.m. a vehicle stop was made on Highway 190 where the vehicle was traveling 10 in a 55. The elderly male driver had no clue where he was. An ambulance subsequently transported the man to HMC and a deputy drove the elderly female passenger to HMC and was able to locate some family who responded to the scene. A driver condition report was submitted to the Department of Revenue.
February 08 LCSO has tried working with a drug treatment center about a detainee who had been furloughed to that location for extended confinement and treatment. LCSO has information the detainee had fled from this place and is getting high on illegal drugs. The treatment center would not cooperate with the LCSO on even confirming if the detainee was there. Information submitted to the Court and warrant entered for the defendant. Information sent to officials in proper jurisdiction to make a face to face visit with the facility.
February 08 LCSO Sgt. Woelfle and Deputy Adam Wynne attended Wheeling Town meeting where area information was exchanged.
February 09 Sheriff Steve Cox attended a community meeting in Dawn where several citizens and sheriff shared area event information. Many concerns were given on vicious dog(s), a specific property there with multiple issues and other topics. In all it was a very good meeting and some great ideas/information was shared.
Morning of February 09, LCSO was swamped assisting the Missouri State Highway Patrol and citizens with accidents, slide-off’s and closed highway due to extremely slick roadways.
February 09 about 2 dozen detainees were scheduled to appear in Livingston County Criminal Court but were excused from appearing due to the unsafe road conditions. Many then appeared via web-x. We appreciate the courts position of safety and concern for all.
February 09 LCSO deputy was requested by the court to take a detainee into custody on a criminal case after allegedly testing positive for drug(s). That person was being escorted to the back of the court room when the person was becoming more aggressive and then threatened to jump out of the 3rd floor court room window. The individual was required to be placed on the floor and restrained and then escorted from the building and taken to jail.
Currently the LCSO has 41 people in custody.
