A Pattonsburg man is facing multiple felony charges from an incident in October in which a minor became ill from consuming a controlled substance that authorities say came from the defendant.

Forty-year old Joseph Elwood Sperry is charged with felony counts of Delivery of a Controlled Substance; Distribution of a Controlled Substance; and Possession of a Controlled Substance.

Officers with the Daviess County Sheriff’s Department say Sperry gave a 17-year old female a bottle of THC tincture which is believed to have contained Opiates. The 17-year old is alleged to have then given the drug to a fellow 14-year old student at school. A probable cause statement from the Sheriff’s Office says the 14-year old female became ill and was taken to the hospital where she tested positive for an almost lethal dose of Opiates and Cannabinoids.

Sperry has a Medical Marijuana card, however authorities say he violated the registration by distributing a controlled substance to a minor.

Sperry is incarcerated in the Daviess-DeKalb Regional Jail on a no-bond warrant. He is set to appear in court in Daviess County in December on a separate charge of Driving While Intoxicated with a minor in the vehicle.
