Congressman Graves Predicts WOTUS Will Be Back in Court

(MissouriNet) New phrasing issued by the Biden administration in the wake of a US Supreme Court defeat has done little to calm the criticism of its “Waters of the United States” rule.

In fact, northern Missouri Congressman Sam Graves accuses the Biden administration of barely paying lip service to the Supreme Court order, claiming the revised rule is just as vague as the previous rule.

The revision issued by the EPA removes the “significant nexus” test that riled its critics. Still, the revision…according to Graves…leaves the rule vague enough to allow the EPA to exert its authority over farms and private property.

Graves says the Supreme Court order requires clarity so landowners know whether their action violates federal law.
